1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and LumaHQ Pty Ltd ("we," "us" or "our"), concerning your access to and use of the https://lumahq.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.

3. User Representations

By using the Site, you represent and warrant that:

4. User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. Cancellation and Refund Policy

All purchases are non-refundable. You can cancel your subscription at any time by logging into your account or contacting us using the contact information provided below. Your cancellation will take effect at the end of the current paid term.

6. Account Data and Retention

You are responsible for exporting or saving any business records you need before closing a workspace or ending your subscription. We may provide export or recovery options, but we do not guarantee indefinite active access to closed or inactive workspaces.

If an account or workspace is deleted, closed, suspended, or inactive, we may disable active access and archive or soft-delete related business data. Because LumaHQ stores accounting records, we may retain invoices, quotes, receipts, bills, reports, audit logs, and related private documents for up to 14 years, or longer where required or permitted by law, dispute handling, security, backup recovery, or accounting obligations.

After the applicable retention period ends, we may delete or de-identify retained data according to our internal retention processes, unless a legal hold or other permitted reason requires continued retention.

7. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors.
